Should you continue to use this website, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern The Stevenator Pty Ltd relationship with you (the Relationship) in connection with this website. Should you not agree with any of these terms and conditions, please do not use our website.
The term ‘The Stevenator Pty Ltd’ or ‘us’ or ‘our’ or ‘we’ refers to Physfitrehab and The Stevenator Pty Ltd, the owner of the website, whose registered office is Unit 10, 205 Montague Road, West End, Queensland. The term ‘you’ or ‘your’ refers to the website user.

15. We reserve the right to vary the Terms & Conditions at any time and these Terms and Conditions may be amended from time to time. It is your responsibility to ensure you are aware of any changes to these Terms and Conditions each time you visit this website. Your continued use of our website following any such amendments will be deemed to be confirmation that you accept the Terms and Conditions.
Payment:
- Bookings and payments can be made online or at your appointment at The Stevenator Pty Ltd
- Physiotherapy appointments are paid for at the time of appointment.
Bookings:
- New clients are asked to fill out a consent and waiver form on arrival or prior to their appointment
Cancellation & Refunds:
- We understand that your schedule can change and we live busy and often unpredictable lives, however, to ensure we are fair and consistent with all clients no exceptions will be made to our Cancellation Policy
- If an appointment is canceled on the day of the booked appointment a fee of $50 the cost is payable. Simply forgetting or "no showing"; an appointment will result in a late fee of 100% of the appointment cost.
Pricing Policy:
- All prices are in Australian dollars (AUD) and include GST (Goods and Services Tax). Please note that Physiotherapy and Clinical Exercise & Pilates sessions do not incur GST (Goods and Services Tax). All transactions are processed in AUD.
Privacy Policy:
The Stevenator Pty Ltd respects your right to privacy and is committed to safeguarding the privacy of our customers and website visitors. We adhere to the Australian Privacy Principles contained in the Privacy Act 1988 (Cth). Our Privacy Policy sets out how we collect and treat your personal information. Any information we collect in relation to you, is kept strictly secured. We do not pass on/sell/swap any of your personal details with anyone.
Personal Agreement/Belongings:
I agree that The Stevenator Pty Ltd is in no way responsible for the safekeeping of my personal belongings while I attend an appointment or a class. I understand that appointments or classes may be physically strenuous and I voluntarily participate in them with full knowledge that there is risk of personal injury, property loss or death. I agree that neither I, my heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against The Stevenator Pty Ltd or its members for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise.
The Stevenator Pty Ltd does not assume responsibility for any lost or stolen personal property. If you do become the victim of a theft, immediately report it to The Stevenator Pty Ltd staff member.
Promotions:
All promotions are subject to availability and inventory. The Stevenator Pty Ltd reserves the right to change, alter, or cancel promotions at any time without notice

Financial Arrangements:
HICAPS and EFTPOS facilities are available for automatic claiming through your private health fund. If you do not have your health fundcard, we will provide you with a receipt to self-claim.
For Insurance claims, if liability for payment of treatment is ceased or denied you will be liable to pay any outstanding costs for treatment and will do so within 14 days of notice.
Photographs/Videos/Social Media:
Unless The Stevenator Pty Ltd receives written notification to the contrary, by booking into an appointment at The Stevenator Pty Ltd it is assumed that you give permission for The Stevenator Pty Ltd to take photographs and videos of appointments in action. It is also assumed that you give permission for said photos/videos to be used for promotional and advertising purposes for The Stevenator Pty Ltd , including but not limited to print media, marketing or promotional material online, or The Stevenator Pty Ltd website and social media. We thank you for your help in providing valuable promotional material for our small business.
Liability Waiver:
All exercise programs involve a risk of injury. By choosing to participate you voluntarily assume a certain risk of injury. By attending The Stevenator Pty Ltd appointments or classes, I affirm that I am solely responsible for my health and wellbeing, as well as my decisions to practice physiotherapy, musculoskeletal screening, assisted stretch therapy or Group Classes. I agree to inform my Physiotherapist of any activities or movements, which I feel could cause injury to myself. I understand that exercise is not recommended and is not safe under certain medical conditions. By attending The Stevenator Pty Ltd appointments or classes, I acknowledge that I do not have any physical conditions of disability that would limit my participation or prelude an exercise program.
The Stevenator Pty Ltd shall not be held liable for any injury, loss or damage to property and/or persons sustained during or as aresult of participation in The Stevenator Pty Ltd appointments or exercise programs.

- other health information about you such as: a record of your symptoms, your relevant medical history, the diagnosis made and the treatment we give you:
- specialist reports
- test results
- your appointment and billing details
- your prescriptions
- your healthcare identifier
- your help fund details
- other information about you collected for the purposes of providing care to you.
HOW DO WE COLLECT AND HOLD YOUR PERSONAL INFORMATION?
We will generally collect personal information about you in these ways:
- directly from you when you give us your details (eg, face-to-face, over the phone, via registration form or an online form)
- from a person responsible for you
- from a third party where we are permitted by law to do that (eg. other health care professionals involved in your care, from your health insurer, from the Cliniko system, from the Output Sports Capture system etc.).
WHY DO WE COLLECT AND USE INFORMATION ABOUT YOU?
We primarily collect and use personal information about you to provide our physiotherapy services to you and to communicate with you and others involved in your care in relation to those services.
We also sometimes use that information for other purposes, including:
- to help us manage our accounts and administrative services, including billing, arrangements with health funds, pursuing unpaid accounts, management of our IT systems and
- to conduct accreditation, quality assurance or internal audits.
WHEN AND WHY MIGHT WE SHARE INFORMATION ABOUT YOU WITH OTHERS?
We may disclose information about you to others outside of our practice as permitted or required under law. This will include situations where we disclose information about you in order:
- to comply with our legal obligations (eg. mandatory reporting under legislation, responding to a court order or subpoena)
- to consult with other health professionals involved in your healthcare
- to get test results from diagnostic and pathology services
- to claim on insurance
- to communicate with your health fund, with government and other regulatory bodies such as Medicare
- to help us manage our accounts and administrative services (eg. billing or debt recovery, arrangements with health funds, pursuing unpaid accounts etc.)to lessen or prevent a serious threat to a patient’s life, health or safety or a serious threat to public health or safety
- to help in locating a missing person
- to establish, exercise or defend an equitable claim through the Cliniko systemin the course of anticipated or existing legal proceedings
- to discharge notification obligations to liability insurers.
YOUR RIGHT TO SEEK ACCESS TO AND SEEK CORRECTION OF THE INFORMATION WE HOLD ABOUT YOU
You have the right to seek access to and correction of the personal information we hold about you.
We will normally respond to your request within 30 days. To make the request, you should contact Stephen Valassakis in writing (contact details provided at the end of this document).
If you think that the information we hold about you is not correct, let us know in writing. We will take reasonable steps to correct your personal information where the information is not accurate or up-to-date. From time to time, we may also ask you to verify that the information we hold about you is correct and current. And please notify us if and when your contact details change (see ‘how to contact us’).
SECURITY: HOW WE HOLD YOUR PERSONAL INFORMATION
We take reasonable steps to protect the information we hold about you. These are designed to prevent unauthorised access, modification or disclosure and to prevent misuse and loss.
YOUR RIGHT TO RECEIVE TREATMENT FROM US ANONYMOUSLY (OR BY USING A PSEUDONYM)
Where it is lawful and practicable for us to do so, you can be treated anonymously or through use of a pseudonym (a name other than yours).
DISCLOSING INFORMATION ABOUT YOU OVERSEAS
We do not propose to disclose information about you to any person or entity overseas. If we want to transfer your personal information overseas, we will first seek your consent, unless we are required by law to do the transfer.

If you have concerns about the way we’ve handled your privacy, let us know. You should do that in writing. We will then try to respond to you within 30 days.
